WHAT IS TRADEMARK REGISTRATION?
Trademark is an intangible asset and intellectual property of a business that protects the investment of the company in its brand. Trademark is a symbol which may be a word, name, number, phrase, symbol, shape, or a combination of colours, or a combination of any of these used to identify particular goods or services and to distinguish them from other similar goods or services. When a Company or an individual identifies a product, symbol, or mark and intends to safeguard the same from being copied or misused, then the trademark registration or brand registration is required.
Trademark registration provides the owner with a right to file a suit for infringement of such intellectual rights. It builds trust and goodwill and also ensures a separate identification in the market. After submitting the application, the symbol “TM” can be used along with the logo, whereas after the logo is registered, the symbol “R” can be used with the logo (registered) to confirm the registration. A registered trademark is valid for ten years and can be renewed further for 10 Years.
Proposed trademarks that are identical to an existing registered trademark cannot be registered. Also, trademark registration cannot be accepted if it is offensive, generic, deceptive, not distinctive, contains specially protected emblems, geographical names, common trade words, and common abbreviations. According to the Trademarks Act, 1999, the trademark registration application in India is restricted to the country only. It does not hold valid in other countries. If you want trademark registration in other countries, the Indian trademark registration can be used for application abroad.
